Terms and Conditions

Version: 2026-10-18

These Terms and Conditions (“Terms”) govern your use of the website and online services operated by Sport Liquidators, L.L.C. (“Sport Liquidators,” “we,” “us,” or “our”), including the rental or lease of ski, snowboard, and related equipment (“Equipment”) and associated services.
These Terms, together with the Privacy Policy, Cancellation and Renewal Policy, any applicable Equipment Rental Agreement and Release of Liability, and any order-specific disclosures presented to you, form a legally binding agreement between you and Sport Liquidators.

1. Acceptance and Electronic Signature

By checking an acceptance box, clicking an acceptance or checkout button, completing a transaction, providing an electronic signature, or otherwise affirmatively accepting these Terms through our Platform, you acknowledge that:

  1. you have had an opportunity to review these Terms and all incorporated policies;
  2. you understand and agree to be legally bound by them;
  3. you consent to conduct the transaction electronically; and
  4. your electronic acceptance is intended to constitute your signature and agreement to the same extent as if you signed a written agreement by hand.

If you do not agree, you may not complete a rental or use Services that require acceptance of these Terms.
If you enter into an agreement on behalf of another person, including a minor renter, you represent that you are legally authorized to do so.

2. Sport Liquidators and Participating Fulfillment Shops

Your rental or lease agreement is with Sport Liquidators, L.L.C.
Sport Liquidators may use independent participating ski shops, rental shops, resorts, or other businesses (“Participating Shops”) to facilitate services such as equipment fitting, inspection, setup, pickup, adjustment, customer assistance, return, and fulfillment.

A Participating Shop is not the lessor or rental provider under your agreement unless expressly stated otherwise. Participating Shops may act as limited fulfillment agents of Sport Liquidators with respect to services they perform on our behalf.

To the fullest extent permitted by applicable law, Participating Shops, and their respective owners, members, officers, employees, agents, and authorized personnel, are intended third-party beneficiaries of those provisions of these Terms that provide releases, limitations of liability, indemnification, or other protections to Sport Liquidators or persons acting on its behalf.
Nothing in these Terms waives any right or liability that applicable law does not permit to be waived.

3. Eligibility; Adult and Guardian Responsibility

You must have legal capacity to enter into a binding agreement.
A parent or legal guardian may enter into a rental for a minor. By doing so, the adult represents that the adult has authority to act for the minor and accepts responsibility for the minor's rental obligations, Equipment, required information, acknowledgments, and applicable releases.
Where a renter is a minor, Equipment will not be released until any required parent or guardian identification, relationship confirmation, acceptance, and signature requirements have been completed.

4. Accuracy of Information

You agree to provide complete and accurate information concerning each renter, including information relevant to safe Equipment selection, fitting, adjustment, and fulfillment.
This may include name, age or date of birth, height, weight, shoe or boot size, skier classification, snowboard stance, rental dates, and other information reasonably necessary to provide or document the rental.
You must promptly advise fulfillment personnel if any information is incorrect.

5. Orders and Availability

Submitting an order does not guarantee that any specific piece of Equipment will be available.
Sport Liquidators or its Participating Shop may substitute reasonably comparable Equipment when necessary to fulfill a rental.
Sport Liquidators may decline, cancel, or refuse to fulfill an order where reasonably necessary because of safety concerns, suspected fraud, payment failure, inaccurate renter information, unavailable Equipment, failure to satisfy legal-document requirements, or other legitimate operational reasons.
Any refund required as the result of cancellation by Sport Liquidators will be handled in accordance with applicable law and the circumstances of the cancellation.

6. Pickup, Inspection, Fitting and Fulfillment

Equipment must be picked up at the Participating Shop or location designated for the rental unless otherwise expressly arranged.
Before Equipment is released, Sport Liquidators or its fulfillment personnel may require:

  • identity and parent/guardian relationship verification;
  • confirmation of renter information;
  • Equipment assignment;
  • fitting or adjustment information;
  • inspection records;
  • ski-binding/DIN information where applicable;
  • acknowledgment of the Equipment issued;
  • acceptance of any required legal documents not previously accepted; and
  • signature of the applicable Equipment Rental Agreement and Release of Liability.

Sport Liquidators may refuse to release Equipment until all required steps are completed.

7. Equipment Use and Care

You agree to use Equipment only for its intended purpose and in a reasonable manner.
You are responsible for the care, custody, and control of Equipment while it is in your possession or in the possession of a renter for whom you are responsible.
You may not sell, pledge, transfer, materially modify, intentionally damage, abandon, or permit unauthorized persons to take possession of Equipment.
If you do not know how to use any Equipment, you must request assistance before using it.

8. Payment

You authorize Sport Liquidators and its payment processor to process charges associated with your rental, including:

  • initial rental charges;
  • applicable taxes;
  • applicable recurring annual rental charges;
  • additional daily rental charges resulting from late return;
  • and other amounts you validly owe under these Terms, to the extent such charges are legally permitted and technically supported.

Payment-card processing is performed by third-party payment providers. Sport Liquidators does not store your full payment-card number or card security code.

9. Annual Rentals and Automatic Renewal

Only rentals expressly identified as annual rentals automatically renew.
Unless timely cancelled in accordance with the Cancellation and Renewal Policy, an annual rental will renew for another annual rental period and the applicable renewal charge may be processed using the authorized payment method maintained by the payment processor.
Renewal pricing, timing, and any legally required renewal notices will be disclosed as required by applicable law.
By accepting an annual rental, you expressly authorize recurring annual charges until the rental is properly cancelled.
The Cancellation and Renewal Policy is incorporated into these Terms.

10. Daily Rentals

Daily rentals are one-time rentals and do not automatically renew.
Daily Equipment must be returned no later than the Participating Shop's closing time on the stated return date.
For every rental day or portion of a rental day that Equipment remains outstanding after the required return deadline, an additional full daily rental charge may accrue.
Late charges do not replace your obligation to return the Equipment and do not limit responsibility for loss or damage.

11. Cancellation and Refunds

Cancellation is governed by the separate Cancellation and Renewal Policy, which forms part of this agreement.
Except where required by applicable law or expressly approved by Sport Liquidators:

  • initial rental charges are final and non-refundable;
  • renewal charges are final and non-refundable once properly charged;
  • early return does not create a prorated refund or credit; and
  • unused rental time is not refundable.

12. Return of Equipment

You must return all Equipment to the location designated by Sport Liquidators or the applicable Participating Shop.
Equipment is not considered returned merely because you have requested cancellation, called or emailed Sport Liquidators or a shop, stopped using the Equipment, or left it somewhere other than an authorized return location.
Return is complete when the Equipment has been physically delivered to authorized personnel and accepted/recorded as returned.

13. Loss, Theft and Damage

You are responsible for loss of, theft of, or damage to Equipment while it is in your possession or under your responsibility, except to the extent prohibited by law.
Sport Liquidators may assess reasonable repair costs for damaged Equipment.
Where Equipment is lost, stolen, destroyed, not returned, or damaged beyond economical repair, you may be responsible up to the applicable full retail or replacement value.
Sport Liquidators may invoice amounts properly due under this section or, where authorized by you and permitted by applicable law, charge an authorized payment method through its payment processor.
These obligations are separate from any late rental charges.

14. Assumption of Risk and Equipment Release

Skiing, snowboarding, and related activities involve inherent and other risks that can result in property damage, serious injury, paralysis, or death.
Before Equipment is released, each applicable renter or parent/guardian must review and sign Sport Liquidators' Equipment Rental Agreement and Release of Liability.
That agreement contains additional acknowledgments, assumptions of risk, releases, indemnification provisions, and equipment-specific terms.
The Equipment Rental Agreement and Release of Liability is incorporated by reference into these Terms when executed.

15. Participating Shop Protections

To the fullest extent permitted by law, Sport Liquidators' Participating Shops and their owners, members, officers, employees, agents, technicians, and authorized personnel are protected parties with respect to claims arising from services performed in connection with a Sport Liquidators rental.
Nothing in this section relieves any person from liability that applicable law prohibits the parties from releasing or limiting.
The customer acknowledges that Participating Shops facilitate fulfillment on behalf of Sport Liquidators and are not parties assuming Sport Liquidators' contractual obligations as lessor.

You agree that Sport Liquidators, Participating Shops acting on its behalf, and service providers supporting the rental may contact you by email, telephone, or text message when reasonably necessary to administer the rental.
Such communications may relate to:
checkout and payment; pickup; renter information; Equipment fitting and safety; fulfillment; required documents; return deadlines; overdue Equipment; cancellations; annual renewal; failed payments; Equipment issues; and other operational matters concerning the rental.
Consent to these operational communications does not constitute consent to unrelated advertising or marketing.

17. Privacy

Collection, use, disclosure, retention, and protection of personal information are governed by the Sport Liquidators Privacy Policy.

18. Platform Use

You may not misuse the Platform, attempt unauthorized access, interfere with Platform operation, submit fraudulent information, impersonate another person, or use the Platform for unlawful purposes.

19. Disclaimer

Except for warranties that cannot lawfully be excluded, Equipment and Services are provided subject to the terms disclosed at rental and fulfillment.
No ski, snowboard, binding, boot, helmet, or other Equipment can eliminate the inherent risks of skiing, snowboarding, or related activities.
Nothing on the Platform constitutes a guarantee of safety.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Sport Liquidators and the protected parties identified in these Terms will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from use of the Platform, Services, or Equipment.
Any additional release or limitation contained in a signed Equipment Rental Agreement and Release of Liability remains fully applicable according to its terms.
Nothing in these Terms limits liability where such limitation is prohibited by law.

21. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Sport Liquidators and its protected parties from third-party claims, losses, liabilities, damages, costs, and reasonable expenses arising from:
your material breach of these Terms; intentional misuse of Equipment; materially false information supplied by you; unauthorized transfer or possession of Equipment; or claims arising from a renter for whom you represented that you were authorized to act.
This provision does not require indemnification to the extent prohibited by applicable law.

22. Governing Law and Venue

These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law rules, except to the extent applicable law requires otherwise.
Subject to any non-waivable consumer rights, legal proceedings arising from these Terms shall be brought in the appropriate state or federal court in Maine.

23. Changes and Versioning

Sport Liquidators may adopt updated Terms prospectively.
The version applicable to a transaction is the version affirmatively accepted in connection with that transaction or later affirmatively accepted by you.
A later version will not be represented as having been accepted at an earlier time.
Where additional acceptance is legally or operationally required, you may be asked to accept an updated version before renewal or further Services are provided.

24. Severability and No Waiver

If any provision is determined to be unlawful or unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law.
Failure by Sport Liquidators to enforce a provision on one occasion does not waive the right to enforce it later.
